Understanding the Endangered Species Act of 1973

Revises the notice requirements with respect to the proposal by the Secretary of regulations relating to the determination of the status of a species, the designation of a critical habitat, and the revision of a critical habitat designation.

The final rule time limit may be extended for 6 months and listings may be grouped together according to similar geography, threats, habitat or taxonomy.

ESA also provides for the designation of critical habitat and prohibits the destruction of that habitat. There is an inadequacy of existing regulatory mechanisms. An example of such a project might be a timber harvest proposed by the US Forest Service.
